DOVER — The trial of a 51-year-old Magnolia man accused of fleeing from police and crashing into another vehicle while causing two injuries in 2013 has been postponed until March 7.
On Wednesday morning, James A. Wilson’s lawyer requested a continuance of the trial for a motion to suppress hearing, which will be held Feb. 25 before Kent County Superior Court Judge Jeffrey Clark.
John Garey is representing Mr. Wilson, with Deputy Attorney General Greg Babowal prosecuting for the state.
The state will file a response to the motion, which will be sent to Judge Clark.
Appearing in court, Mr. Wilson affirmed to the judge that he waived his right to a speedy trial due to the motion and continuance.
He was arrested on April 4, 2013, and seven trial dates have been postponed since, beginning on Sept. 17, 2013.
According to the Dover Police Department at the time, Mr. Wilson allegedly drove away from the area as a search warrant with his name on it was executed at the “Many Things” business at 239 W. Loockerman St. at approximately 4:50 p.m. The search warrant was part of a drug investigation, police said.
Mr. Wilson’s vehicle struck a pickup truck after running a red light, police alleged, and two people were taken to the hospital for injuries. Mr. Wilson was taken into custody after a short foot chase, according to Dover Police.
No drugs were located at the business that was searched, police said, and an undisclosed amount of money was seized as an investigation continued.
On June 3, 2013, Mr. Wilson was indicted by a Kent County grand jury on charges of second- and third-degree assault, possession of a deadly weapon during the commission of a felony, disregarding a police officer’s signal, resisting arrest, leaving the scene of a collision, two counts of criminal mischief and four alleged driving offenses, including speeding.
