Maryland motorist indicted for fatal crash near Kenton

DOVER — A Maryland resident is facing a second-degree vehicular homicide charge after a Kent County grand jury returned an indictment Monday.

The matter in Superior Court was connected to police investigation into a fatal motor vehicle crash on May 11 west of Kenton that left a 21-year-old Maryland man dead, according to court papers.

Kevin T. Perry, 21 at the time of the crash, also was charged with driving a vehicle while under the influence of alcohol and/or drugs, and careless or inattentive driving, court documents said.

Delaware State Police investigated the crash at approximately 1:36 a.m. on Sudlersville Road east of the western end of Owls Nest Road, authorities said when announcing the alleged incident.

Authorities said preliminary investigation found that a 2001 Chevrolet Tahoe was traveling eastbound when it failed to negotiate a curve in the roadway and continued to travel straight.

Eventually, police said, the vehicle struck a Delaware Department of Transportation sign with the passenger side mirror and went through a grassy ditch before striking a culvert and going airborne.

The Tahoe struck a tree with its right front bumper before stopping, police said.

Police said Mr. Perry was wearing a seatbelt at the time of the crash, and was removed by EMS; he was taken to Bayhealth-Kent General Hospital in Dover where he was treated for non-life threatening injuries.

The passenger, who police said was not wearing a seatbelt, was pronounced dead at the scene.
