DOVER — A September trial date is set for a 26-year-old Dover man accused of perjury during a August 2014 murder trial against him, authorities said.
Gerard T. “Jerry” Schweiger was indicted June 1, 2015 on two counts of first-degree perjury and one count of second-degree conspiracy regarding testimony during a trial in which he was found not guilty of murdering Tony Mozick Sr. in Leipsic on Jan. 5, 2013.
A Final Case Review is scheduled for Sept. 16, 2015 in Kent County Superior Court, followed by a Sept. 21 opening trial date. Deputy Attorney General Brian Robertson is prosecuting for the state, and lawyer Eugene Maurer is representing Mr. Schweiger.
Phillip M. Wright, of Harrington, was indicted on a single count each of first-degree perjury and second-degree conspiracy after investigation into the alleged perjury issues. He has a July 30 Case Review scheduled, according to the Delaware Department of Justice. Mr. Wright was 26 at the time of his arrest on April 1, 2015, police said.
According to police at the time of Mr. Schweiger’s arrest, investigation began shortly after he was released from prison in September 2014.
After the new charges were filed, Mr. Schweiger was held at James T. Vaughn Correctional Center near Smyrna on a $54,000 cash bond, along with a $25,000 cash bond for an administrative warrant obtained by Probation and Parole, police said.
In the Mozick trial concluded on Aug. 29, 2014, Mr. Schweiger was found guilty of abusing a corpse, breach of release, tampering with physical evidence, hindering prosecution and second-degree conspiracy.
